What the worst that could happen to someone who was scamming microsoft points through xbox live?

I know a guy who has cheated me and now my friends and I want to stop and get my / your microsoft points back. (I feel pretty stupid) Is there any way possible to do this? What happened was that someone said they worked for Bungie and I would recon armor customized for 4000 Microsoft Points and take 48 hours to process, Microsoft can CANCL their membership Xbox Live?
